Club Policies
Background Checks
DAC reserves the right to conduct criminal and credit reports on any individual requesting access to DAC services and facilities. DAC reserves the right to refuse service to any individual at its sole discretion, provided such refusal is not based on discriminatory practices prohibited by law.
Non-Monthly Payments
Non-monthly payments can be made with a credit card, debit card, or personal check. If paying with a credit card, a 3% service fee will be applied to the charge.
Monthly Billing
Monthly dues must be taken electronically from either a credit card, debit card, checking account, or savings account. Monthly dues will be billed on the first day of each month. If paying with a credit card, a 3% service fee will be applied to the charge.
If the payment does not go through on the first, the individual will be charged a $25 decline fee and the individual will be restricted at check-in until the balance is paid. If the monthly dues are charged on a credit card and declined, then another attempt will be made on the fifth of the month. If the monthly dues are drawn from a bank account and declined, then another attempt will be made on the tenth of the month. If the member still has late charges on the 18th of the month, the individual will be charged an additional $25 late fee.
An individual is not allowed to participate in programs or use the facilities until unpaid balances are paid in full. If your account is past due it may be turned over to a collection agency. If your account is not paid in full and this account is turned over to a collection agency and/or attorney, then you agree to be responsible for all reasonable fees necessary for the collections of the delinquent account including, but not limited to, collection agency fees for 50% of the balance due and cost and reasonable attorney’s fee of 33% of the balance.
Cancellation and Refund
This contract is subject to early cancellation as follows: (1) within 3 business days after the first business day after the contract is signed by you. (2) you may cancel this contract in the event you move residences and such move results in your residence being located farther than 25 miles from DAC and you shall be liable for only that portion of the charges allocable to the time before reasonable evidence of your relocation is presented to DAC plus a fee equal to the lessor of 10% of the unused contract balance or $50, or (3) your death or disability which results in your inability to use or receive all services contracted for, you, or your estate as the case may be, shall be liable for only that portion of the charges allocable to the time prior to death or the onset of disability. DAC shall have the right to require and verify reasonable evidence of such death or disability. Any notice of cancellation shall be made in writing and delivered by certified or registered mail to Decatur Athletic Club at 1010 W South Side Dr Decatur, IL 62521. All refunds to which you or your estate is entitled shall be made within 30 days of receipt of the cancellation notice.
Written cancellation notices must be received before the first of the month. I understand that cancellation notices on or after the first of the current month may not take effect until the end of the following month. I further understand that I will be responsible for all dues and charges until the cancellation takes effect and my contract is terminated. Except as otherwise expressly provided herein, if an individual needs to terminate their contract before it is completed, then the member will be charged a $200 cancellation fee.
Monthly Contract Completion
Once an individual starts a monthly contract, the individual’s rates will not change during the time of the contract. Once the monthly contract period is complete, the agreement will automatically roll into a month-to month format with the same monthly rate. It is the responsibility of the individual to cancel their membership. After the monthly contract period is completed and the individual is currently in the month-to month format, if DAC has increased the rates for that respective option, then the individual will be informed prior to a higher monthly rate being applied (such rate may not exceed 110%) of the rate the individual was paying at the time the original contract period ended. Once the initial contract period has been completed, it is the responsibility of the member to cancel their agreement. If the agreement is cancelled prior to the first of a month, then they will not be charged for an additional month.
Code of Conduct
DAC is a family-friendly environment. Individuals are expected to act accordingly. DAC may need to terminate a contract due to inappropriate behavior. In these rare instances, dues already paid will not be refunded.
Upgrade
If a member is currently on a 12-month membership contract period and decides they want to upgrade to another option, then they may without being required to pay the early cancellation fee. The upgrade would start the “calendar” over. An upgrade is defined as moving to an option that has a higher monthly fee.
Putting a DAC Membership on Hold
There are times a member may need to put their DAC membership on hold because they, say, plan on being out of state for an extended period. If a member has a monthly contract, they can put their membership on hold for $10 per month. Those months do not count toward the initial completion of their monthly contract period.
Medical Freeze
If a membership needs to be put on freeze for medical reasons, the member needs to provide DAC with a doctor’s note every three months to stay on a freeze unless the original note states how long. For a medical freeze, there is no hold fee applied.
Military Service
If a member is relocated out of the area due to military service, then the member can cancel their membership or put it on hold and there will be no hold fees or cancellation charges applied. Evidence of the military’s actions for the move or deployment needs to be provided. Upon cancellation due to such relocation, any prepaid fees shall be reimbursed in accordance with the terms of their contract.
Participation
I understand that the amount and extent to which I participate in exercise and other activities with DAC is my responsibility. My failure to use DAC facilities does not constitute grounds for refund or cancellation.
Release from Liability
The individual agrees that use of the facility will be at their own risk. The individual waives any claims for injury to them or for damage, loss or theft of their property arising out of or in connection with the use of DAC.
Marketing Release
I grant DAC, its representatives, and employees the right to take photographs and/or videos of me and my property in connection with the subject(s) identified above. I authorize DAC’s assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that DAC may use such photographs and/or videos of me and my property with or without my name and for any lawful purpose including, for example, publicity, illustration, advertising, web content, and social media.
Legally Binding Agreement
Your contract is effective upon signing and cannot be cancelled by the individual except as provided above. All prices include pro-rated fees and monthly dues. The contract is valid upon acceptance by DAC management.
Communication
I understand that this agreement is further subject to the rules and regulations adopted by DAC from time to time as such rules are posted at DAC, published on DAC’s website or otherwise provided to those using the facility. Any changes to DAC policies may be emailed to those having profiles in our system. Therefore, please keep your email address at DAC updated.
